The Failure of the 28-Article Ceasefire Plan for Ukraine: How Peace Negotiations Continue to Falter

Europe felt a moment of respite on Monday, as the crisis triggered by the introduction of a new 28-article proposal for ending the war appeared – momentarily – to have been stabilised. A Washington representative spoke of "significant advancement" after diplomatic discussions in Geneva. On Monday night, the Kremlin made its response: an extensive attack of rocket attacks on Kyiv.

The Pattern of Negotiation and Warfare

The chain of conflicting incidents captured the harsh reality of the current period. By day, diplomatic battles are waged: optimistic declarations are released from different nations. Significant resources is expended on containing specific proposals. By night, the Kremlin brutally reminds the world that, for them, military action persists as the main instrument for achieving "settlement".

Nocturnal Warfare

As Russia's attack developed into the early hours of Tuesday, the immediate reality of Ukraine's vulnerability was revealed. Ukraine is capable of detecting missile launches from enemy soil, a capability enabled by timely intelligence. From vantage locations, defense planes that had been dispatched to intercept incoming aerial threats flew past – advanced fighter aircraft delivered to Ukraine by European allies.

Soon thereafter, Kyiv's anti-aircraft weapons activated: defensive missiles deployed against a incoming threat. This was a sophisticated defense system at work, presumably supplied through Western nations. Every deployment shakes the surroundings, shaking the windows. The moment of terror quickly becomes grim resignation: maybe the incoming missile won't cause damage this time, sparing the city from catastrophe and additional electricity failures.

Continuous Dangers

Not long after, a heavy machine gun fired at a unmanned aircraft close by, part of a mobile-fire group – most likely imported technology. Sadly, the bullets missed the hostile drone – it pressed on overhead toward its objective.

Intermittently, this persisted until dawn. Kyiv awoke to the early updates: seven people killed, devastation and utility failures in numerous residences as a result of the nocturnal offensive. As typically, everyone still maintained normal activities – living the war. But those 24 hours illustrated Ukraine's vital need on external assistance – a reliance that European nations are demonstrably unable to replace in the immediate future.

Ineffective Peace Efforts

The 28-point plan from US administration sparked intense emotion, controversy and deep concern – and briefly redirected concern from Ukraine's major integrity crisis in years. Yet, we have witnessed similar scenarios, after earlier high-level meetings and bilateral conferences.

Every new approach from American administration unfolds according to the identical sequence: a negotiation push against Ukraine, which Kyiv, with other European capitals, effectively counters. They manage the tension but never actually achieve victory. This trend will, no doubt, persist.

Tactical Assessments

It is easy to blame certain parties of persistently promoting Kremlin's demands. But that does not seem to be the entire situation. Washington works based on a premise well known to international relations experts: you cannot achieve through diplomacy what you have been unable to protect through force. The American government assumes that it is unrealistic to force Russia to abandon the territory that it currently occupies in Ukraine's occupied territories.

The issue is that while recognising this factual reality, US leadership does minimal to deter Moscow, through statements or actions, from assuming that the status quo will not evolve additionally in its favour in the near future.

Divergent Views

Therefore, Russian leadership is certain that time is on his side – that Ukraine and its allies are approaching exhaustion. Their incentive to accept conditions that does not give them the maximum possible gain is virtually nonexistent. There may be many attempts to stop fighting, but they will persist as long as Russia's leader remains completely certain in the outcome.

On the contrary, Ukraine's government believes that Ukraine can still hold out, slowly losing civilians and areas but avoiding a complete military breakdown until conditions improve in its benefit.

Existing Situation

Realistically, there are no real preconditions for a truce. Now, subjective factors are entering the equation: leadership ambitions to broker a ceasefire and achieve global acclaim, and Ukrainian leadership's double obstacles – on one hand, not to estrange crucial supporters, and on the other, to unite the population around the national cause against any initiative Kyiv finds unsuitable, so that their focus does not switch to homefront challenges. And although their mission will now be considerably more difficult after latest incidents, it remains quite doubtful that this will alter their fundamental strategy.

These opposing factors are driving the talks.

Assessment and Future

It took a mere seven days to eliminate the 28 points of the most recent proposal. Assertive and inconsistent approach of the matter by US administration, opposition by Ukraine and the remaining European nations, along with calming attempts of negotiators, and finally, recent disclosures, all achieved their purpose.

While new initiatives based on old ideas are forthcoming, Kyiv, London and other allied nations should arrive at a critical understanding: Ukraine and Europe will only be able to counter diplomatic offensives from Washington that are based on Russian demands and reflect specific hesitation to change the course of events, if they remain united and improve their protective measures at a considerably quicker tempo. If they do, neither external pressure nor military threats will be able to break them. In the meantime, Ukraine's ability to repel nightly air assaults will, for the coming months, mainly require ongoing international assistance.
